Aceptación de los Términos

Al acceder a lottuscompany.com, descargar cualquiera de nuestros productos o adquirir una licencia de software, el Usuario acepta quedar vinculado por los presentes Términos de Servicio en su versión vigente. Si el Usuario no está de acuerdo con alguno de los términos aquí establecidos, deberá abstenerse de utilizar los productos y servicios de Lottus Company.

Lottus Company se reserva el derecho a actualizar estos Términos en cualquier momento. Los cambios serán publicados en esta misma página e indicarán la fecha de la última actualización. El uso continuado de los productos tras la publicación de cambios implica la aceptación de los mismos.

Descripción de los Productos

Lottus Company desarrolla y comercializa aplicaciones de escritorio profesionales para Windows, dirigidas a particulares y negocios. Los productos actuales incluyen:

• Memorix: software de gestión para cementerios y servicios funerarios. Permite administrar parcelas, registros de difuntos, contratos, pagos e informes.
• Pétalo: software de gestión para floristerías. Permite gestionar inventario, pedidos, clientes y facturación.

Todos los productos son aplicaciones de escritorio que funcionan de forma local y offline en el dispositivo del Usuario. No requieren conexión permanente a Internet para su uso habitual, salvo para los procesos de activación de licencia y descarga de actualizaciones.

Artículo 4

Licencias de Uso

Tras la adquisición y pago de una licencia, Lottus Company otorga al Usuario un derecho de uso personal, no exclusivo, intransferible y revocable para instalar y ejecutar el software en un único dispositivo de su titularidad, exclusivamente para las finalidades descritas en la documentación del producto.

La licencia adquirida otorga al Usuario:

• Derecho de uso del software en la versión adquirida y todas sus actualizaciones menores (correcciones de errores y mejoras de rendimiento).
• Acceso al soporte técnico por correo electrónico durante el período de vigencia de la licencia.
• Derecho a instalar el software en un único dispositivo. Si el Usuario desea instalarlo en un segundo dispositivo, deberá adquirir una licencia adicional.

La licencia no otorga al Usuario ningún derecho sobre el código fuente, el diseño interno del software ni sobre ninguna propiedad intelectual de Lottus Company más allá de lo expresamente indicado.

Artículo 5

Restricciones de Uso

El Usuario se compromete a no realizar, directa ni indirectamente, ninguna de las siguientes acciones:

1. Copiar, reproducir, distribuir, revender o ceder el software o la licencia a terceros, de forma gratuita u onerosa.
2. Realizar ingeniería inversa, descompilar, desensamblar o intentar obtener el código fuente del software por cualquier medio.
3. Modificar, adaptar, traducir o crear obras derivadas del software sin autorización expresa y por escrito de Lottus Company.
4. Eliminar, alterar u ocultar cualquier aviso de copyright, marca registrada u otra notificación de propiedad incluida en el software.
5. Utilizar el software para fines ilegales, fraudulentos o que vulneren derechos de terceros.
6. Compartir, transferir o sublicenciar la clave de activación a cualquier persona o entidad ajena al titular de la licencia.
7. Usar el software en más dispositivos de los permitidos por la licencia adquirida.

El incumplimiento de cualquiera de estas restricciones dará lugar a la rescisión inmediata de la licencia sin derecho a reembolso, y podrá derivar en acciones legales por parte de Lottus Company.

Artículo 6

Período de Prueba Gratuito

Durante el período de prueba, el Usuario podrá utilizar el software sin restricciones funcionales. Una vez transcurrido dicho período, el software solicitará la activación mediante una licencia válida para continuar funcionando.

Lottus Company recomienda encarecidamente al Usuario aprovechar el período de prueba para verificar la compatibilidad del software con su sistema y evaluar si el producto satisface sus necesidades antes de proceder a la compra.

Artículo 7

Precios y Pagos

Los precios de las licencias se muestran en la página del producto correspondiente en lottuscompany.com e incluyen los impuestos aplicables. Lottus Company se reserva el derecho a modificar los precios en cualquier momento, si bien los cambios no afectarán a las compras ya realizadas.

El pago se realiza en el momento de la compra y es condición necesaria para la entrega de la clave de licencia. Lottus Company no almacena datos bancarios ni de tarjetas de crédito del Usuario; toda la información de pago es procesada de forma segura por el proveedor de pagos externo a través del cual se realiza la transacción.

Tras la confirmación del pago, el Usuario recibirá la clave de activación en la dirección de correo electrónico proporcionada durante el proceso de compra. Si no recibe la clave en un plazo razonable, puede ponerse en contacto con [email protected].

Artículo 8

Actualizaciones y Soporte Técnico

Lottus Company se compromete a publicar actualizaciones periódicas de sus productos con el objetivo de corregir errores, mejorar el rendimiento y añadir nuevas funcionalidades. Las actualizaciones menores (correcciones y mejoras) están incluidas en la licencia adquirida sin coste adicional.

El soporte técnico se presta exclusivamente a través del correo electrónico [email protected]. El tiempo de respuesta habitual es de 24 a 48 horas hábiles. Lottus Company se esforzará por resolver las incidencias reportadas en el menor tiempo posible, aunque no puede garantizar plazos de resolución concretos para problemas de complejidad elevada.

El soporte técnico cubre el funcionamiento del software en condiciones normales de uso. No cubre daños causados por un uso inadecuado, modificaciones no autorizadas, incompatibilidades con software de terceros no documentadas, ni problemas derivados de sistemas operativos fuera de los requisitos mínimos publicados.

Artículo 9

Propiedad Intelectual

Todos los derechos de propiedad intelectual sobre el software, incluyendo pero no limitándose al código fuente, código compilado, diseño de interfaz, logotipos, iconos, documentación y materiales de marketing, son titularidad exclusiva de Lottus Company y están protegidos por las leyes aplicables en materia de propiedad intelectual.

La adquisición de una licencia únicamente otorga al Usuario un derecho de uso en los términos descritos en el Artículo 4 de los presentes Términos. No se produce en ningún caso transmisión de la propiedad ni de ningún otro derecho sobre el software más allá del de uso expresamente concedido.

Artículo 10

Exclusión de Garantías y Limitación de Responsabilidad

El software se proporciona "tal cual" y "según disponibilidad". Lottus Company no garantiza que el software esté libre de errores, interrupciones o incompatibilidades con entornos específicos de hardware o software. En ningún caso Lottus Company será responsable de:

• Pérdida de datos, beneficios o ingresos derivados del uso o la imposibilidad de uso del software.
• Daños indirectos, incidentales, especiales o consecuentes, aunque Lottus Company hubiera sido advertido de la posibilidad de dichos daños.
• Problemas derivados de factores externos al control de Lottus Company, como fallos de hardware del Usuario, incompatibilidades con software de terceros o interrupciones del suministro eléctrico.

En todo caso, la responsabilidad máxima de Lottus Company frente al Usuario quedará limitada al importe abonado por la licencia del producto afectado.

Artículo 11

Política de Reembolsos

Lottus Company ofrece una garantía de satisfacción. Para conocer en detalle las condiciones aplicables, el Usuario puede consultar la Política de Reembolsos.

Artículo 12

Rescisión y Terminación de la Licencia

La licencia permanecerá vigente indefinidamente salvo que sea rescindida por alguna de las siguientes causas:

• Por parte del Usuario: el Usuario puede rescindir la licencia en cualquier momento dejando de utilizar el software y eliminándolo de su dispositivo. Si la rescisión se produce dentro del período cubierto por la garantía de reembolso, el Usuario podrá solicitar la devolución del importe abonado conforme a la Política de Reembolsos.
• Por parte de Lottus Company: Lottus Company se reserva el derecho a revocar la licencia de forma inmediata y sin previo aviso en caso de incumplimiento de los presentes Términos por parte del Usuario, en particular de las restricciones de uso recogidas en el Artículo 5. En este caso no procederá reembolso alguno.

Artículo 13

Privacidad y Protección de Datos

El tratamiento de los datos personales del Usuario se rige por la Política de Privacidad de Lottus Company, disponible en lottuscompany.com. Al aceptar los presentes Términos, el Usuario declara haber leído y aceptado también dicha Política de Privacidad.

Artículo 14

Legislación Aplicable y Resolución de Conflictos

Los presentes Términos de Servicio se rigen en su totalidad por la legislación española. Para la resolución de cualquier controversia derivada de la interpretación, cumplimiento o ejecución de estos Términos, las partes se someten expresamente a la jurisdicción de los Juzgados y Tribunales de España, con renuncia a cualquier otro fuero que pudiera corresponderles.

Antes de acudir a la vía judicial, Lottus Company invita al Usuario a contactar directamente con el equipo de soporte para intentar resolver cualquier discrepancia de forma amistosa y eficiente.

Acceptance of Terms

By accessing lottuscompany.com, downloading any of our products, or purchasing a software license, you agree to be bound by these Terms of Service as currently in effect. If you do not agree with any of the terms set out here, you must refrain from using Lottus Company's products and services.

Lottus Company reserves the right to update these Terms at any time. Changes will be published on this page with an updated date. Continued use of the products after changes are published constitutes acceptance of those changes.

Product Description

Lottus Company develops and sells professional desktop applications for Windows, designed for individuals and businesses. Current products include:

• Memorix: cemetery and funeral services management software. Allows you to manage plots, deceased records, contracts, payments and reports.
• Pétalo: florist shop management software. Allows you to manage inventory, orders, customers and invoicing.

All products are desktop applications that run locally and offline on the User's device. A permanent internet connection is not required for normal use — only for license activation and downloading updates.

Article 4

Software License

Upon purchase and payment of a license, Lottus Company grants the User a personal, non-exclusive, non-transferable and revocable right to install and run the software on a single device owned by the User, solely for the purposes described in the product documentation.

The purchased license grants the User:

• The right to use the software in the purchased version and all its minor updates (bug fixes and performance improvements).
• Access to email technical support for the duration of the license.
• The right to install the software on one device. A separate license must be purchased for each additional device.

The license does not grant the User any rights over the source code, internal design of the software, or any intellectual property of Lottus Company beyond what is expressly stated.

Article 5

Use Restrictions

The User agrees not to, directly or indirectly:

1. Copy, reproduce, distribute, resell or assign the software or license to third parties, whether for free or for payment.
2. Reverse engineer, decompile, disassemble or attempt to obtain the source code of the software by any means.
3. Modify, adapt, translate or create derivative works of the software without prior written authorization from Lottus Company.
4. Remove, alter or conceal any copyright notice, trademark or other proprietary notification included in the software.
5. Use the software for illegal or fraudulent purposes, or in ways that infringe third-party rights.
6. Share, transfer or sublicense the activation key to any person or entity other than the license holder.
7. Use the software on more devices than permitted by the purchased license.

Breach of any of these restrictions will result in immediate termination of the license without right to a refund, and may result in legal action by Lottus Company.

Article 6

Free Trial Period

During the trial period, the User may use the software without functional restrictions. Once the trial period ends, the software will prompt for activation with a valid license to continue working.

Lottus Company strongly encourages Users to take advantage of the trial period to verify software compatibility with their system and assess whether the product meets their needs before purchasing.

Article 7

Pricing and Payment

License prices are shown on the corresponding product page at lottuscompany.com and include applicable taxes. Lottus Company reserves the right to change prices at any time, although changes will not affect purchases already made.

Payment is made at the time of purchase and is a prerequisite for the delivery of the license key. Lottus Company does not store the User's bank or credit card details; all payment information is securely processed by the external payment provider through which the transaction is made.

After payment is confirmed, the User will receive the activation key at the email address provided during checkout. If you do not receive the key within a reasonable time, please contact [email protected].

Article 8

Updates and Technical Support

Lottus Company is committed to publishing regular product updates to fix bugs, improve performance and add new features. Minor updates (fixes and improvements) are included in the purchased license at no additional cost.

Technical support is provided exclusively via email at [email protected]. The usual response time is 24 to 48 business hours. Lottus Company will endeavour to resolve reported issues as quickly as possible, though specific resolution timeframes cannot be guaranteed for highly complex problems.

Technical support covers the software functioning under normal usage conditions. It does not cover damage caused by misuse, unauthorized modifications, undocumented third-party software incompatibilities, or issues arising from operating systems that do not meet the published minimum requirements.

Article 9

Intellectual Property

All intellectual property rights in the software — including but not limited to source code, compiled code, interface design, logos, icons, documentation and marketing materials — are the exclusive property of Lottus Company and are protected by applicable intellectual property laws.

Purchasing a license only grants the User a right of use as described in Article 4 of these Terms. No ownership or any other rights over the software beyond those expressly granted are transferred under any circumstances.

Article 10

Disclaimer of Warranties and Limitation of Liability

The software is provided "as is" and "as available". Lottus Company does not guarantee that the software will be free from errors, interruptions or incompatibilities with specific hardware or software environments. In no event shall Lottus Company be liable for:

• Loss of data, profits or revenue arising from the use or inability to use the software.
• Indirect, incidental, special or consequential damages, even if Lottus Company has been advised of the possibility of such damages.
• Issues arising from factors outside Lottus Company's control, such as User hardware failures, third-party software incompatibilities or power outages.

In any case, Lottus Company's maximum liability to the User shall be limited to the amount paid for the license of the affected product.

Article 11

Refund Policy

Lottus Company offers a satisfaction guarantee. For full details of the applicable conditions, please refer to the Refund Policy.

Article 12

License Termination

The license remains valid indefinitely unless terminated for any of the following reasons:

• By the User: the User may terminate the license at any time by ceasing to use and deleting the software. If termination occurs within the refund guarantee period, the User may request a refund in accordance with the Refund Policy.
• By Lottus Company: Lottus Company reserves the right to revoke the license immediately and without notice in the event of a breach of these Terms by the User, in particular the use restrictions in Article 5. No refund will be issued in this case.

Article 13

Privacy and Data Protection

The processing of the User's personal data is governed by the Privacy Policy of Lottus Company, available at lottuscompany.com. By accepting these Terms, the User declares to have also read and accepted that Privacy Policy.

Article 14

Governing Law and Dispute Resolution

These Terms of Service are governed entirely by Spanish law. For the resolution of any dispute arising from the interpretation, compliance or enforcement of these Terms, the parties expressly submit to the jurisdiction of the Courts and Tribunals of Spain, waiving any other jurisdiction that may apply.

Before resorting to legal proceedings, Lottus Company encourages the User to contact the support team directly to try to resolve any disagreement amicably and efficiently.
